These terms are written to be read. Where a clause can be plain, it is plain; where a legal term of art is unavoidable, we use it and mean it. "ProxyNomad", "we" and "us" mean the operator of the proxynomad.com service; "you" means the account holder.
1. The service
ProxyNomad provides access to a network of residential, mobile, ISP and datacenter proxy exits, reached through authenticated gateways and managed through a dashboard. We route traffic; we do not originate, own or control the content you request or the targets you request it from.
2. Accounts and vetting
Accounts are for businesses and professional use. Before activating an account we ask what you intend to collect and from where, and we may decline service based on the answers or on the absence of them. You are responsible for keeping credentials confidential and for all traffic authenticated as you. If credentials leak, tell us immediately; rotating them is instant and free, and traffic before the rotation remains yours.
3. Billing
- Metered products are billed per gigabyte of traffic delivered through the gateway, measured at the gateway, both directions. Requests that fail inside our network are not billed. Responses delivered from the target are billed regardless of their status code.
- Purchased traffic does not expire while your account is open, and is not re-priced by later rate changes.
- Balances are held per product type. Conversions between types within 30 days of purchase are made at published rates on request.
- Per-IP products renew monthly until you release the IPs. There are no minimum terms beyond the current month.
- Unused metered traffic is refundable for 30 days from purchase. Per-IP products are not refunded mid-month; they simply do not renew.
- When a balance reaches zero, service on that product stops with a
402response. Nothing converts into debt without your explicit action. - Prices exclude VAT and similar taxes, which are added where the law requires.
4. Acceptable use
The acceptable use policy is part of these terms. It is not decorative: violations of its bright-line categories end the account immediately, and other violations end it after a documented conversation. You are responsible for the lawfulness of your collection, including any obligations you carry toward the data you collect and the targets you collect it from.
5. Service levels and support
We do not publish an uptime percentage, because a self-reported number without an auditor is decoration. What we commit to: commercially reasonable efforts to keep the network available and the pool healthy, honest status communication during incidents, and support replies from an engineer within four working hours, counted Monday through Saturday in our time zone. Where a gateway failure costs you delivered-traffic charges, those charges are reversed; that is what "failed requests are not billed" means in an incident.
6. Your data
What we collect and retain, including connection metadata, and what we never inspect, is described in the privacy policy. Summary with contractual force: we do not inspect the content of your tunneled traffic, and we retain connection metadata for 90 days for billing and abuse prevention.
7. Intellectual property
The service, site, and documentation are ours; the data you collect through the network, and the responsibility for it, are yours. Neither side receives rights in the other's property beyond what is needed to provide and use the service.
8. Termination
You can close your account at any time; refunds follow section 3. We can terminate for violations as described in section 4, or for any reason with 30 days written notice, in which case unused purchased traffic is refunded in full regardless of the 30-day window.
9. Warranties and liability
The service is provided as is. We do not warrant that any target will accept traffic from any exit, that success rates will meet any threshold, or that the service is fit for a particular purpose; a proxy network cannot honestly warrant those things, and we will not pretend to. To the extent the law allows, our total liability under these terms is capped at the amounts you paid us in the twelve months before the event giving rise to the claim, and neither side is liable to the other for indirect or consequential loss. Nothing here limits liability that cannot lawfully be limited.
10. Indemnity
You indemnify us against third-party claims arising from your traffic and your use of the collected data, except to the extent the claim arises from our breach of these terms. This is the counterpart of a network that does not inspect your traffic: we cannot police your legal position, so it remains yours.
11. Changes
We may update these terms. Material changes are announced to account holders by email at least 30 days before they take effect; continued use after that date is acceptance. If you object, close the account and section 8's refund rules apply.
12. Law and forum
These terms are governed by Italian law. Disputes go to the courts of Milan, Italy, except where mandatory consumer or local law gives you a non-waivable alternative.
